These Terms of Service (“Terms”) govern all purchases and use of the Penguin Peptides LLC website and products. By accessing this website or purchasing products from Penguin Peptides LLC (“Company”, “we”, “us”, or “our”), you agree to be bound by these Terms. If you do not agree, do not use this website or order products.

1. Research Use Certification

By placing an order with Penguin Peptides LLC, you explicitly certify and warrant that:

  • Products are purchased solely for laboratory, analytical, and scientific research purposes.
  • You are a qualified researcher or affiliated with an entity qualified to handle technical chemicals and compounds.
  • Products will not be used for human consumption, clinical trials, or personal use.
  • Products will not be used for veterinary, agricultural, medical, therapeutic, cosmetic, or diagnostic applications.
  • You assume full legal and operational responsibility for the safe and lawful use of all ordered materials.

2. Regulatory Compliance Responsibility

The customer agrees to comply with all applicable local, state, federal, and international laws and chemical handling regulations. Penguin Peptides LLC makes no representation regarding the regulatory or legal status of any compound in any specific jurisdiction. The buyer is entirely responsible for verifying local compliance prior to ordering.

3. Assumption of Risk

The customer acknowledges that research compounds may carry unknown physical, chemical, or biological risks, and that safety and efficacy profiles have not been established. Improper handling, storage, or application may cause injury or financial loss. The customer assumes all risk associated with product receipt, storage, handling, experimental use, and proper hazardous disposal.

4. No Medical Advice or Claims

All information on this website—including product guides, reconstitution tables, and technical specifications—is provided strictly for educational and informational purposes. Nothing on this website constitutes medical advice, clinical guidance, or therapeutic claims. Products sold are not drugs, biological agents, medical devices, or dietary supplements.

5. Final Sale Policy & Quality Protocols

Due to the sensitive and perishable nature of laboratory research materials:

  • All sales are final. Returns or exchanges are not permitted for change of mind or excess ordering.
  • Returns or replacements are accepted exclusively for verified manufacturing defects, which must be reported within 5 calendar days of delivery.
  • Shipping damage must be reported within 48 hours of delivery with clear photos of unopened vials and damaged packaging.
  • Opened, punctured, or altered products are strictly non-refundable.

6. Shipping, Signature & Risk Transfer

  • Shipping Territory: Deliveries are limited strictly to addresses within the United States.
  • Signature Requirement: Orders valued at $700 USD or greater require an adult signature upon delivery.
  • Transfer of Risk: Title and risk of loss pass to the customer immediately upon carrier pickup. A carrier tracking delivery scan constitutes definitive legal proof of fulfillment.
  • Carrier Delays & Addresses: We are not responsible for postal delays, transit disruptions, or misdeliveries caused by incorrect address information provided during checkout.
  • Immediate Storage: The customer is solely responsible for placing compounds into proper cold-chain storage ($\le -20^\circ\text{C}$ or $2\text{–}8^\circ\text{C}$) immediately upon arrival.

7. Fraud Prevention & Transaction Monitoring

To safeguard merchant operations and maintain regulatory compliance, Penguin Peptides LLC reserves the right to employ fraud scoring tools, IP logging, device fingerprinting, address verification services (AVS), and identity validation checks. Orders flagged for elevated risk may be canceled without prior notice.

8. Chargeback Abuse & Dispute Policy

The customer agrees to contact support at sales@penguinpeptides.us.com to resolve any order issues prior to initiating a credit card dispute or chargeback. In the event of a fraudulent chargeback:

  • Penguin Peptides LLC will submit complete transaction records, delivery proof, IP logs, and compliance records to card networks.
  • Fraudulent chargebacks may result in account termination, placement in merchant fraud databases, referral to third-party collection agencies, and legal action.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the total liability of Penguin Peptides LLC for any claim arising from purchase or use shall not exceed the total amount paid by the customer for the specific order in question.

Penguin Peptides LLC shall not be liable for direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of research data, experimental failure, personal injury, regulatory fines, or business interruption.

10. Indemnification

You agree to defend, indemnify, and hold harmless Penguin Peptides LLC, its officers, directors, employees, and agents from any claims, liabilities, losses, damages, legal fees, or enforcement actions resulting from your breach of these Terms, improper research handling, misuse of materials, or violation of applicable laws.

11. Age Requirement & Intellectual Property

  • Age Restriction: You must be at least 21 years of age to purchase products or register an account.
  • Intellectual Property: All content, product text, design frameworks, logos, and digital assets on this site are the property of Penguin Peptides LLC. Unauthorized copying, scraper scraping, or commercial reproduction is strictly prohibited.

12. Order Acceptance & Right to Refuse

Penguin Peptides LLC reserves the right to refuse service, cancel orders, limit order quantities, or terminate accounts at its sole discretion if non-compliant, fraudulent, or non-laboratory usage is suspected.

13. Governing Law, Jurisdiction & Modifications

  • Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles.
  • Jurisdiction: Any legal dispute or court proceeding shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming.
  • Modifications: We reserve the right to revise these Terms at any time. Continued use of the website following published updates constitutes acceptance of the modified terms.
